We operate the website www.foxworthrealestategroup.com (the “Site”), as well as any other related products, services, websites, applications, communications, or services that link or otherwise refer to these Terms and Conditions (collectively, the “Services”).

These Terms and Conditions constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and The Foxworth Real Estate Group concerning your access to and use of the Services.

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right to update or modify these Terms and Conditions from time to time. The “Last Updated” date at the top of this document will indicate when revisions were made. Your continued use of the Services after revised Terms are posted constitutes acceptance of those changes.

2. OUR SERVICES

The information and Services provided through our Site are intended primarily for individuals interested in real estate services, including buying, selling, relocating, investing in, or obtaining information concerning real property.

Information provided through the Services is for general informational purposes and should not be considered legal, tax, financial, lending, appraisal, inspection, insurance, or other professional advice.

Real estate information, including property listings, pricing, availability, estimated values, market statistics, mortgage information, tax information, school information, neighborhood information, and similar data may change without notice.

Nothing on the Site constitutes a guarantee that:

  • A particular property remains available;

  • A seller will accept an offer;

  • A buyer will qualify for financing;

  • A property will appraise at a particular amount;

  • A property will sell for a particular price;

  • A transaction will close;

  • A particular financing program or interest rate will be available; or

  • Any particular investment result will occur.

Users should independently verify information that is important to their real estate decisions.

3. REAL ESTATE BROKERAGE DISCLOSURE

The Foxworth Real Estate Group provides real estate brokerage-related services through appropriately licensed real estate professionals.

Use of this Site, completion of an online form, receipt of an automated property search, communication through social media, or other general interaction with the Company does not by itself establish a broker-client, fiduciary, agency, or representation relationship.

Any representation relationship will be governed by applicable Texas law and any written representation agreement executed by the appropriate parties.

Consumers should review all required brokerage disclosures and representation documents provided during a real estate transaction.

4. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Services and their original content, features, functionality, branding, graphics, logos, photographs, videos, text, website design, databases, and other materials are owned by or licensed to The Foxworth Real Estate Group and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal and lawful use.

Except as expressly permitted by us, you may not:

  • Copy or reproduce substantial portions of the Site;

  • Republish our content;

  • Sell, rent, sublicense, or commercially exploit our content;

  • Remove copyright, trademark, or proprietary notices;

  • Modify or create unauthorized derivative works from our materials;

  • Use our photographs, videos, branding, logos, marketing materials, or designs without authorization; or

  • Represent our materials as your own.

Third-party trademarks, listing information, brokerage logos, MLS information, and other third-party materials remain the property of their respective owners.

5. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

  1. The information you provide to us is truthful and accurate;

  2. You have the legal capacity to agree to these Terms;

  3. You will not access or use the Services for an unlawful purpose;

  4. Your use of the Services will comply with applicable federal, state, and local laws;

  5. You will not attempt to interfere with the operation or security of the Site; and

  6. You will not use information obtained through our Services to harass, threaten, discriminate against, defraud, or otherwise harm another person.

6. USER REGISTRATION AND ACCOUNT INFORMATION

Certain Services may allow or require users to submit personal information, create an account, save properties, request information, or register for property alerts.

You are responsible for maintaining the confidentiality of any login credentials associated with your account and for activity conducted through your account.

You agree to provide accurate and current information and promptly update information when necessary.

We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or are used for fraudulent, abusive, or unlawful purposes.

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than those for which we make the Services available.

You agree not to:

  • Systematically retrieve data or content from the Services to create or compile a collection, database, or directory without written permission;

  • Trick, defraud, or mislead us or other users;

  • Circumvent or interfere with security-related features;

  • Disparage, tarnish, or otherwise harm the Company through unlawful conduct;

  • Use information obtained from the Services to harass, abuse, or harm another person;

  • Improperly use customer service channels or submit false reports;

  • Use the Services in violation of applicable laws or regulations;

  • Engage in unauthorized framing or linking to the Site;

  • Upload or transmit viruses, malware, Trojan horses, or other harmful material;

  • Use automated systems, bots, scripts, scraping tools, or similar technology to improperly access the Services;

  • Attempt to impersonate another person or user;

  • Attempt to bypass measures designed to restrict access to the Services;

  • Copy or adapt the Site’s software or technology without authorization;

  • Use the Site or its information in a manner that violates fair housing, anti-discrimination, or other applicable real estate laws.

8. FAIR HOUSING AND NON-DISCRIMINATION

The Foxworth Real Estate Group supports equal housing opportunity.

We conduct our real estate activities in accordance with applicable federal, state, and local fair housing laws.

We do not discriminate in the provision of real estate services based upon any characteristic protected by applicable law.

Users may not use our Services, communications, property information, or other resources to engage in unlawful housing discrimination.

9. USER-GENERATED CONTRIBUTIONS

The Services may allow users to submit information, comments, reviews, photographs, messages, inquiries, testimonials, or other content (“Contributions”).

By submitting Contributions, you represent that you have the necessary rights to submit that material and that your Contributions do not violate applicable laws or the rights of another person.

You remain responsible for your Contributions.

We reserve the right, but not the obligation, to remove content that we determine is unlawful, abusive, fraudulent, defamatory, infringing, misleading, or otherwise inappropriate.

10. THIRD-PARTY WEBSITES AND SERVICES

Our Services may contain links to third-party websites, lenders, title companies, inspectors, insurance providers, home service providers, government agencies, MLS systems, social media platforms, or other outside services.

Unless specifically stated otherwise, we do not control these third parties and are not responsible for their websites, services, privacy practices, availability, accuracy, or content.

A link or reference to a third party does not necessarily constitute an endorsement or guarantee of that third party’s services.

You are responsible for reviewing the terms and privacy policies of third-party services before using them.

11. PROPERTY LISTINGS AND MLS INFORMATION

Property information displayed through our Services may originate from Multiple Listing Services (“MLS”), property owners, public records, third-party data providers, real estate professionals, or other sources.

Although we attempt to provide useful and current information, we cannot guarantee that all property information is complete, current, or error-free.

Property characteristics such as square footage, acreage, room dimensions, school assignments, taxes, HOA information, zoning, property condition, boundaries, and other information should be independently verified by the consumer.

Listings may be changed, withdrawn, sold, leased, placed under contract, or otherwise become unavailable without notice.

12. FINANCING AND MORTGAGE INFORMATION

Any mortgage rates, payment estimates, affordability calculations, down-payment examples, closing-cost estimates, or financing information presented through our Services are estimates only.

Actual loan terms are determined by the lender and may depend upon creditworthiness, income, assets, debt, property eligibility, loan program requirements, interest rates, market conditions, and other factors.

The Foxworth Real Estate Group does not guarantee loan approval or specific financing terms.

13. PRIVACY

Your privacy is important to us.

Our collection, use, and disclosure of personal information may also be governed by our separate Privacy Policy, which should be read together with these Terms and Conditions.

By using the Services, you acknowledge that information may be collected and processed as described in our Privacy Policy.

14. ELECTRONIC COMMUNICATIONS

Visiting the Site, completing an online form, sending us an email, requesting property information, or communicating electronically with us constitutes electronic communication.

You consent to receive communications from us electronically when permitted by law.

Electronic communications and electronic signatures may satisfy legal requirements that communications be in writing to the extent permitted by applicable law.

15. TEXT MESSAGES AND TELEPHONE COMMUNICATIONS

If you voluntarily provide your telephone number and consent to communications, you may receive calls or text messages relating to your inquiry, property search, real estate services, appointments, transactions, or other requested Services.

Message and data rates may apply.

Consent to receive marketing communications is not a condition of purchasing property or obtaining real estate brokerage services.

Where applicable, you may opt out of marketing text messages by replying STOP or by contacting us directly.

16. SITE MANAGEMENT

We reserve the right, but are not obligated, to:

  • Monitor the Services for violations of these Terms;

  • Take appropriate action against anyone who violates applicable law or these Terms;

  • Restrict or disable access to the Services;

  • Remove content that places an unreasonable burden on our systems;

  • Manage the Services in a manner designed to protect our rights and property; and

  • Maintain the proper operation of the Services.

17. TERM AND TERMINATION

These Terms remain in effect while you use the Services.

We reserve the right, to the extent permitted by law, to deny access to the Services to any person who violates these Terms or uses the Services for fraudulent, abusive, unlawful, or harmful purposes.

Termination of access does not eliminate obligations or liabilities incurred before termination.

18. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to modify, update, suspend, discontinue, or remove any part of the Services at any time.

We cannot guarantee that the Services will always be available.

Hardware, software, maintenance, cybersecurity incidents, Internet interruptions, third-party service interruptions, or other circumstances may result in temporary interruptions.

We are not responsible for losses caused solely by temporary inability to access the Site, except where liability cannot legally be excluded.

19. GOVERNING LAW

These Terms and your use of the Services are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute relating to these Terms or the Services will be handled in accordance with applicable Texas and federal law.

20. DISPUTE RESOLUTION

Before initiating formal legal proceedings, the parties are encouraged to attempt in good faith to resolve disputes through direct communication.

Nothing in this section prevents either party from seeking relief available under applicable law.

Any mandatory dispute-resolution, mediation, arbitration, venue, or jurisdiction provision should be reviewed by qualified Texas legal counsel before being incorporated into these Terms.

21. CORRECTIONS

Information on the Services may occasionally contain typographical errors, inaccuracies, omissions, pricing errors, or outdated information.

We reserve the right to correct errors, omissions, or inaccuracies and update information without prior notice.

22. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We make reasonable efforts to provide accurate and useful information but do not warrant that all information available through the Services will always be accurate, complete, reliable, current, or error-free.

Nothing provided through the Site replaces professional advice from an attorney, CPA, lender, appraiser, inspector, surveyor, insurance professional, tax professional, or other appropriately qualified professional.

23. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, The Foxworth Real Estate Group and its owners, affiliated real estate professionals, contractors, employees, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from the use of or inability to use the Services.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

24. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Foxworth Real Estate Group and its affiliates, representatives, contractors, employees, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your unlawful use of the Services;

  • Your violation of these Terms;

  • Your violation of another person’s rights; or

  • Content you submit through the Services.

25. USER DATA

We may maintain certain data transmitted through the Services for purposes of operating and improving the Services and complying with applicable legal obligations.

Although reasonable safeguards may be used, no electronic storage or transmission system can be guaranteed to be completely secure.

You are responsible for maintaining copies of information you consider important.

26. CALIFORNIA USERS AND RESIDENTS

California residents may have additional consumer and privacy rights under California law.

Where applicable, California residents should consult our Privacy Policy for information concerning their privacy rights and methods for submitting applicable privacy requests.

27. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

28. ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy and any additional written agreements applicable to specific Services, constitute the agreement governing your use of the Site and Services.

These website Terms do not supersede signed real estate brokerage agreements, representation agreements, purchase contracts, listing agreements, leases, or other transaction-specific agreements.
